The petitioner has admittedly been granted the appointment as of now. The only claim that remains is that the petitioner being higher in the merit, his date of appointment should be from the date when his juniors had been appointed. We find merit in this plea. We accordingly dispose of this writ petition as infructuous with a further direction that the petitioners would be entitled to count hisr date of appointment from the date when his juniors had got appointment for all intents and purposes, but he will not be entitled to payment of any arrears of salary.
