This revision petition is directed against theorder dated 12.4.2006 vide which the petitioner-defendants' evidence has been closed after observing that despite the grant of second last opportunity, they failed to conclude the same.
In view of the nature of the order which I propose to pass, since no prejudice is likely to be caused to the respondents, I am not inclined to issue notice of motion.
Learned Counsel for the petitioners has referred to various orders passed by the trial court from time to time, in order to contend that, not so many opportunities have been granted to the petitioners to lead its evidence. He further states that the case is now fixed before the trial court on 26th
July, 2006. He further undertakes that the petitioners shall produce their entire evidence, if one opportunity is given to them.
After hearing Learned Counsel for the petitioners, this revision Civil Revision No.2976 of 2006 -: 2 :-
petition is disposed of with a direction to the trial court to give one more opportunity to the petitioners to lead their remaining evidence. The said opportunity shall be granted on or before 26th July, 2006, subject to the
condition that the petitioners shall pay cost of Rs.5,000/- to the respondent- plaintiffs.
Disposed of.
