Smt. Bimla Devi Rattan and Ors.
Present: Shri I.K. Mehta, Senior Advocate with Shri M.S. Kohli, Advocate for the petitioner.
Ms. Aarti Thakur, Advocate for the respondents.
Surya Kant, J. (Oral)
This revision petition has been preferred by the j udgment-debtor (JD) against an order dated 2nd March, 2004 passed by the
Executing Court whereby the petitioner's objection to the effect that the entire decretal amount has already been paid, has been turned down.
After hearing Learned Counsel for the parties at length, it appears that the calculations in relation to the petitioner's liability need to be worked out again by the Executing Court. In order to give a fair opportunity to both the parties to explain as to whether the decree has been fully satisfied or not, it is directed that the petitioner (JD) and the respondent (DH) shall file their statement of accounts on or before 30th July,
Civil Revision No.4159 of 2004 -: 2 :-
2006. The Executing Court shall thereafter re-determine as to whether the petitioners are still liable to pay something to the respondent-decree holders or not.
Copy of the order be given dasti on payment of usual charges.
