Present: Shri Vinod S.Bhardwaj,Advocate, for the petitioner.
After arguing the case for some time, learned counsel for the petitioner says that the present petition be dismissed as withdrawn with a liberty to the petitioner to take up all such pleas and raise all such objections which are available to him in accordance with law before the trial Magistrate.
Learned counsel further states that keeping in view the facts and circumstances of the case and the averments made in the petition, the personal appearance of the petitioner be exempted in proceedings before the trial Court.
In view of the aforesaid statement of the learned counsel for the petitioner, the present petition is dismissed as withdrawn with a liberty as claimed by the petitioner.
Personal appearance of the petitioner shall remain exempted in proceedings before the trial Court. However, the trial court would be well within its rights to require the presence of the petitioner on such date as may be deemed appropriate.
A copy of the order be given dasti on usual charges.
