In view of reasons given in application, which is accompanied by an affidavit, it is allowed and 590 days delay in re-filing the appeal stands condoned.

Vide order, under challenge, application of the appellant, under Section 30/33 of the Arbitration Act, 1940, was dismissed. It is apparent from the records that Arbitrator was none other than an employee of the appellant. At the time of arguments, counsel has failed to show that the Arbitrator has mis-conducted himself during proceedings before him or that reference was not in accordance with terms and conditions of the contract and further that the award not passed according to the provisions of contract agreement. While dismissing objections, the Court below has noticed in detail the evidence led by both the parties. No case is made out for interference in pure findings of facts. No substantial question of law has been raised.
