Learned counsel for the respondents has produced before us the original answer sheet of the petitioner as well as the sealed cover contained the material recovered from him by the Flying Squad on the date of examination.
We have opened the aforesaid sealed cover and compared the answer sheet of the petitioner with the material recovered from him. We are satisfied that the material recovered from the petitioner had been used by him while attempting the answer in question.
In this view of the matter, we find that the petitioner had indeed used unfair means while appearing the said examination.
Consequently, we do not find any justification to interfere in the present petition. The same is dismissed.
The original record is returned back to Dr. B.M.Singh,learned counsel appearing for the respondents.
