Parties appear, prima facie, to have arrived at a settlement.
The petitioners have offered to pay respondent no.2, a sum of Rs.6.00 lacs.
Counsel for respondent no.2, on instructions states that the aforementioned amount is acceptable, in full and final settlement of all claims. It has also been agreed between the parties that all litigations pending between them shall be withdrawn/ compromised/compounded/quashed etc. They have also agreed that the husband and wife would file a petition under Section 13-B of the Hindu Marriage Act or pray for alteration of the petition for grant of divorce, pending in the Court of Additional Sessions Judge, Teez Hazari Courts, Delhi.
Counsel for the parties pray for time to file a written settlement, as also affidavits of the parties, accepting the settlement.
Adjourned to 4.9.2006.
In the meanwhile, personal appearance of the petitioners before the trial Court shall remain exempted, subject to their filing an affidavit, undertaking to appear before the trial Court, as and when so directed.
Liberty is granted to the petitioners to appear through counsel.
A copy of this order be given dasti under the signatures of the Court Secretary.
