Heard. In the facts and circumstances of this case, no notice is required to be sent to any of the respondents. It is contended that a total compensation of Rs, 2,51,353/-was awarded to Rishi Pal injured-petitioner, but later on, he became unsound mind due to the injuries. The total awarded amount was deposited in the name of Rishi Pal vide F.D.R No. 531910 dated 16.2.2006 at Oriental Bank of Commerce Maharana Partap Chowk, Karnal. Smt.Kamla, mother of Rishi Pal injured is a widowed lady and she is stated to have incurred huge amount on the treatment of her son Rishi Pal after taking a loan, which remains to be paid. In these circumtances, it is contended that the awarded compensation be paid.
Taking into account the aforesaid contention of learned counsel for the petitioner, it is directed that the petitioner shall be entitled to take a sum of Rs. One lac out of the deposited amount in his favour from the aforesaid bank in order to meet the expenses incurred on his treatment. Since Rishi Pal is of unsound mind,therefore, the aforesaid amount of Rs one lac, shall be released by the bank in favour of his mother Smt.Kamla against proper identification.
This petition is disposed of in the aforesaid terms.
