for the petitioners.
Counsel for the petitioners contends that the alleged identity theft, committed by their distributors, by using the identity of another subscriber in issuing 95 other prepaid SIM cards, would not lead to the commission of any criminal offence. It is further contended that similarly situated co-accused, though in different FIRs, have already been granted interim protection by this Court, vide orders dated 9.6.2006, passed in Crl.Misc.Nos.35238.M and 35240.M of 2006 respectively.

Meanwhile, in the event of their arrest, the petitioners shall be released on interim anticipatory bail to the satisfaction of the Arresting Officer, subject to the following conditions :-
i)that they shall make themselves available for interrogation by a police officer as and when required;
ii)that they shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
iii)that they shall not leave India without the previous permission of the Court.
