Respondents No.2 and 3 have raised a preliminary objection with regard to territorial jurisdiction of this Court. It has been claimed that the main relief claimed by the petitioner is against the aforesaid respondents and this Court does not have any territorial jurisdiction over the said respondents.
We find that the aforesaid objection raised by the respondents deserves to be accepted.
The petitioner claims that he had purchased a lottery ticket issued by the lotteries department of Government of Sikkim, Gangtok and the aforesaid ticket was a winning ticket.
Consequently, we are satisfied that the petitieorn is reqruied to approach the Court of competent jurisdiction seeking the necessary relief.
Dismissed with a liberty to the petitioner to approach the Court of competent jurisdiction claiming the necessary relief.
