Prayer in this petition is for quashing of proceedings arising out of the cross version in FIR No.137 dated 20.10.2002 registered under Sections 325/323/148/149 IPC at Police Station Civil Lines, Batala.
Counsel for respondent No.2 submits that after the framing of charges, evidence has been recorded and the only witness left to be examined is SHO .
Faced with the aforementioned statement, counsel for the petitioners prays that the present petition be dismissed as withdrawn with liberty to raise all the points raised herein before the trial Court.
Allowed, as prayed for.
Counsel for the petitioners further prays that as the petitioners are ladies, their personal appearance before the trial Court be exempted.
The personal appearance of the petitioners before the trial Court is exempted subject to their filing an affidavit, undertaking to appear before the trial Court as and when so directed.
Liberty is granted to appear through counsel.
It is made clear that in case the petitioners do not appear before the trial Court as and when so directed, the trial Court would be at liberty to cancel the bail bonds of the petitioners.
