The controversy in the instant writ petition pertains to the payment of Dearness Allowance on family pension. In so far as the instant issue is concerned, learned counsel for the petitioner has placed reliance on the decision rendered by this Court in Mukhtiar Singh and others vs. State of Punjab and others (C.W.P.No.891 of 2003, decided on 20.01.2004), based on the decision rendered by the Apex Court in Sahib Ram vs. State of Haryana and others, 1994(5) Services Law Reporter 753.

Learned counsel for the respondents has placed reliance on the decision rendered by the Apex Court in Union of India and others vs. Smt.
Sujatha Vedachalam and another, (2000) 9 SCC 187. The issue raised by the respondents, based on the decision rendered by the Apex Court in Smt.
Sujatha Vedachalam's case (supra) has also been adjudicated upon by this Court in Ranjit Singh vs. State of Punjab and others (C.W.P.No.7907 of 2004, decided on 16.5.2006).
In view of the above, we are satisfied that the instant writ petition deserves to be disposed of in terms of the decision rendered by this Court, in Mukhtiar Singh's case (supra).
The instant writ petition is, accordingly, allowed in the same terms as Mukhtiar Singh's case (supra).
