Vide order under challenge, application of the petitioner under Section 151 of the CPC to lead further evidence was dismissed. In that application, it was case of the petitioner that on account of order passed in an application made by the respondent on 26.10.2004, necessity has arisen to lead further evidence. As earlier when no cross-examination of his witness was made by the respondent, he closed his evidence.
Today, in connected Civil Revision No.634 of 2005, counsel for the respondent has made a statement that his application, on the basis of which, order dated 26.10.2004 was passed be deemed to have been withdrawn.
In view of this, the ground on which the present application was moved has become non-existent. Accordingly, this revision petition has become infructuous and is disposed of accordingly.
