Notice of motion to the respondents.

On the asking of Court, Shri Sukhdip Singh Brar, Additional Advocate General, Punjab, accepts notice on behalf of respondents No.1 to 4.

The primary grievance of the petitioner is that the order dated August 28, 2003 (Annexure P.1) passed by the Zonal Level Dispute Settlement Committee and the order dated June 8, 2006 (Annexure P.3) passed by the Dispute Settlement Authority, Punjab State Electricity Board, Patiala are totally non-speaking order and no reason has been spelt out either by the Zonal Level Dispute Settlement Committee or by the Dispute Settlement Authority, respondents No.3 and 2, respectively to reject the claim of the petitioner.

After going through the record of the case and having perused the order dated June 8, 2006 (Annexure P.3) passed by the Dispute Settlement Authority, we are satisfied that the grievance made by the petitioner is wholly justified. No reason whatsoever has been given in the order (Annexure P.3) passed by the Dispute Settlement Authority.

Consequently, we allow the present petition and quash the order dated June 8, 2006 (Annexure P.3) passed by the Dispute Settlement Authority and direct the Dispute Settlement Authority, respondent No.2 to pass a fresh detailed speaking order after providing an opportunity of hearing to the petitioner.

A copy of the order be given dasti on payment of usual charges.
