for the petitioner.
Counsel for the petitioner contends that the petitioner has been summoned as an accused in a trial, pending under the NDPS Act, without going into the fact that the narcotic was recovered from a truck bearing chasis No.380910GBQ747204 with no engine number, whereas the chasis number of the petitioner's truck is 426010JYH718813 and engine No.10H62199916. It is further contended that the accused was misusing the number plate of the petitioner's truck, which itself cannot be said to be an offence, committed by the petitioner.
Notice of motion for 1.9.2006.
Meanwhile, proceedings, qua the petitioner, before the trial Court, shall remain stayed till further orders.
