Harbans Singh & Ors v. State of Punjab & Ors - CWP-7905-2006 [2006] RD-P&H 3760 (6 July 2006)
IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH
CWP NO.7905 OF 2006
DATE OF DECISION:22.05.2006
Harbans Singh and others ....Petitioners Versus
State of Punjab and others ....Respondents.
CORAM: HON'BLE MR.JUSTICE J.S. KHEHAR
HON'BLE MR.JUSTICE P.S. PATWALIA
PRESENT: Mr. Ranjit Saini, Advocate for the petitioners.
J.S. Khehar, J. (oral)
The petitioners are all engaged in the Tarn Taran Depot of the Punjab Roadways. By the impugned order, they have been transferred to Ferozepur Depot or Muktsar Depot of the Punjab Roadways. It is the contention of the learned counsel for the petitioners that the petitioners being the junior most have the least stay in the Tarn Taran Depot and as such they should not have been picked up for this transfer.
It is not possible for us to accept the instant contention of the learned counsel for the petitioners. A perusal of the impugned order reveals that the petitioners were transferred on account of the fact that they are in excess in their parent Depot i.e. Tarn Taran Depot. If they had not been transferred by the impugned order, they would have possibly been retrenched. It is, therefore, apparent that it was to accommodate and retain the petitioners in their employment that the instant transfer order has been passed.
CWP NO.7905 OF 2006 2
For the reasons recorded above, we find no merit in this petition. The same is accordingly dismissed.
