This appeal has been filed against order dated 6.5.2005 passed under Section 27 of the Hindu Marriage Act, 1955 in favour of the respondent-wife.
Record reveals that the order is ex-parte against the appellant.
Counsel for the appellant states that the order was got passed by concealing material facts. If that is so, the appellant may approach the same Court for necessary relief.
Liberty is granted to the appellant for moving an application for setting-aside the ex-parte order. The trial Court is directed to consider that application sympathetically, if the appellant is in a position to show that a mis-statement had been made by the respondent-wife.
Disposed of in the above terms.
