Present : Mr.Ashit Malik, Advocate,

for the petitioners.


Counsel for the petitioners contends that the petitioners are the beneficiaries of a collusive decree, allegedly suffered by petitioner No.1's husband, and the father of petitioners No.2 & 3, in their favour, with the object of violating an agreement to sell. It is further contended that as the petitioners were not parties to the agreement to sell, no criminal offence could be made out against them.

Meanwhile, in the event of their arrest, the petitioners shall be released on interim anticipatory bail to the satisfaction of the Arresting Officer, subject to the following conditions :-

i)that they shall make themselves available for interrogation by a police officer as and when required;

ii)that they shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;

iii)that they shall not leave India without the previous permission of the Court.
