Dr. Parminder Singh and Ors. v. State of Punjab & Ors - CWP-10340-2006 RD-P&H 4059 (13 July 2006)
C.W.P. NO. 10340 OF 2006
DATE OF DECISION 13.7.2006
Dr. Parminder Singh and Others. ---Petitioners Versus
State of Punjab and others ---Respondents Coram: Hon'ble Mr. Justice J.S.Khehar
Hon'ble Ms. Justice Kiran Anand Lall
Present: Sh. Gagandeep Singh, Advocate,
for the petitioners.
J.S.Khehar, J. (Oral)
The solitary claim raised by the petitioners is for the award of annual grade increment in the revised pay scale of the post of Medical Officer. For the aforesaid purpose, the petitioners are stated to have issued a legal notice dated 19.6.2006 (Annexure P-9). Learned counsel for the petitioners states that no decision has been taken thereon by the respondent. He further states that the petitioners will be satisfied if the instant writ petition is disposed of with a direction to respondent No. 2 i.e.
the Director, Health and Family Welfare Punjab requiring him to take a final decision on the aforesaid legal notice dated 19.6.2006 (Annexure P-9).
Notice of motion.
On our asking, Mr. Ashok Aggarwal, Addl. A.G Punjab, accepts notice on behalf of respondents No. 1 to 8.
Learned counsel for the respondents states that he has no objection to the disposal of the instant writ petition in terms of the prayer made by learned counsel for the petitioners.
In view of the above, without going into the merits of the claim raised by the petitioners, we consider it just and appropriate to dispose of the instant writ petition with a direction to respondent No. 2 i.e. the Director, Health and Family Welfare Punjab, to take a final decision on the legal notice dated 19.6.2006 (Annexure P-9), by passing a well reasoned speaking order within two months from the date of receipt of a certified copy of this order. It would be appreciated if respondent No. 2 while passing the aforesaid order takes into consideration the decision rendered by this Court in the case of Dr. Ravinder Singh and others versus State of Punjab and another(CWP No. 7288 of 2005 decided on 11.5.2006) and any other relevant judgment on the point. In case, the petitioners are found entitled to any monetary benefit, the same shall be calculated and released to the petitioners within a further period of one month.
Disposed of accordingly.
Copy of the order be given Dasti as well to the petitioners.
