A preliminary objection has been raised on behalf of learned counsel appearing for the respondents to the effect that the petitioners have not impleaded the land owners, who are necessary parties and on whose land the State Bank of India is raising the building in question.
Faced with the aforesaid difficulty, the learned counsel appearing for the petitioners wishes to withdraw the present petition CM No.8456 of 2006 and
with a liberty to the petitioners to file a fresh petition impleading all the necessary parties.
Dismissed as withdrawn with liberty, as aforesaid.
