CWP NO.7466 of 2006
DATE OF DECISION: July 18, 2006
Chandigarh Administration and others
CORAM:- HON'BLE MR. JUSTICE VINEY MITTAL
HON'BLE MR. JUSTICE H.S.BHALLA
PRESENT: Shri Vikas Jain, Advocate for the petitioner.
The writ petition filed by the tenant petitioner was dismissed by this Court vide order dated May 16, 2006.
The present application has been filed by the petitioner seeking a review/recall of the aforesaid order. It has been pleaded in the application that in pursuance to a liberty granted to the landlord vide order dated April 27,2006 passed in CWP No.4607 of 2006, the landlord has already initiated proceedings for re-transfer of the property and has offered to make payment of all the outstanding dues, as required by law. It is further pleaded by the applicant that in the aforesaid proceedings the landlord has asked for the eviction of the tenant-applicant.
If that be so, it would be open to the tenant-applicant to file an appropriate application before the competent authority and oppose the prayer made by the landlord, seeking eviction of the RA No.147 of 2006 in
tenant-applicant. We further direct that if the site in question is re- transferred to the landlord, then the tenant would be entitled to retain the premises in accordance with law.
With the aforesaid observations, the present application is disposed of accordingly.
