DATE OF DECISION: July 13, 2006
The State of Haryana and others
CORAM:- HON'BLE MR. JUSTICE VINEY MITTAL
HON'BLE MR. JUSTICE H.S.BHALLA
PRESENT: Shri N. Prabhakar, Advocate for the petitioner.
The petitioner has approached this Court challenging the eligibility criteria for admission to the five years MBBS/BDS course.
It has been claimed that the aforesaid criteria laid by the State of Haryana and Maharishi Dayanand University is not conformity with the regulations framed by the Ministry of Health, Government of India as well as the guide-lines issued by the Medical Council of India.
From the perusal of the record, we find that the prospectus/information brochure was issued for admission in the month of March 2006. The petitioner thereafter had also appeared in the entrance test for the admission to the aforesaid course. Having failed to achieve 50% of marks in English subject, the petitioner has now approached this Court through the present petition.
Once the admission process is already commenced and the petitioner has participated in the said process, the petitioner cannot be heard to make any grievance with regard to any eligibility criteria.
