Om Parkash v. State of Haryana - CRM-25603-M-2006 [2006] RD-P&H 4190 (17 July 2006)

IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH.

Crl.Misc.No.25603-M of 2006

Om Parkash Vs. State of Haryana and others Present : Mr. Parminder Singh, Advocate for the petitioner.

Mr.Deepak Girotra, AAG, Haryana.

Prayer in this petition is, for the issuance of directions for conducting an independent investigation into FIR No.416 dated 31.10.2005, registered under Sections 61(1), 63-63A, Excise Act, 1914 and Sections 420,272,273,467,468,471 of the Indian Penal Code at Police Station Gharaunda.

Counsel for the State of Haryana, submits that the challan has been presented, pursuant whereto, charges have been framed and evidence is in progress. It is contended that investigation has been conducted, in accordance with law.

I have heard learned counsel for the parties and perused the paper book and am satisfied as to the nature of investigation. Even otherwise, as the matter is now pending consideration before the trial Court, it would not be appropriate for this Court to set out its opinion, with respect to the investigation.

Consequently, the present petition is dismissed.
