Dilbagh Singh and another Vs. State of Punjab Present : Mr. H.S. Mann, Advocate, for the petitioners.

Prayer in this petition is for grant of anticipatory bail in case FIR No.132 dated 19.10.2005, registered under Sections 324,447,323,34,326 of the Indian Penal Code at Police Station Dialpura, Distt. Bathinda.

The petitioners approached this Court by way of Crl.Misc.No.69735-M of 2005 praying for grant of anticipatory bail. This petition was disposed of on 3.1.2006 and the petitioners were directed to surrender before the trial Court on or before 16.1.2006 and file an application for regular bail, which would be decided by the trial Court, in accordance with law, within two days of its filing. The petitioners' arrest was stayed, till the filing of the application for grant of regular bail or 16.1.2006, whichever was earlier.

On 13.1.2006, the petitioners application for regular bail was dismissed by the Sub Divisional Judicial Magistrate, Phul. The said application was filed without surrendering before the trial Court.

The petitioners, thereafter, filed an application praying for grant of bail before the Additional District and Sessions Judge, Bathinda, again, without surrendering. This application was dismissed vide order dated 17.1.2006.

The petitioners filed another petition, namely; Crl.Misc.No.4152-M of 2006, before this Court praying for grant of anticipatory bail. On 23.1.2006, upon statement made by counsel for the petitioners, this petition was dismissed as withdrawn.

The petitioners have once again filed the present petition, for grant of anticipatory bail. In view of the facts noticed herein above, as their prayer for grant of anticipatory bail has already been declined, the present petition does not merit consideration. Dismissed.
