Prayer in this petition is, for grant of anticipatory bail in case FIR No.111 dated 28.5.2006, registered under Sections 306,363,366,120-B of the Indian Penal Code, at Police Station Basti Jodhewal, Distt. Ludhiana.
Counsel for the State of Punjab submits that after investigation of the FIR, Section 376 of the Indian Penal Code has also been added, implicating petitioner no.1 for an offence of rape.
Counsel for the petitioners prays that the present petition be dismissed as withdrawn qua petitioner no.1.
Allowed as prayed for.
In so far as respondent no.2 is concerned, it is contended that she is the mother-in-law of the deceased. As per the allegations in the FIR, the deceased committed suicide as her husband had illicit relationship with her younger sister. As no specific allegations have been levelled against petitioner no.2, consequently, the order of this Court dated 15.6.2002 is made absolute, qua petitioner no.2 only. She will continue to join the investigation as and when required by the Investigating Officer and shall comply with all the terms and conditions of Section 438 of the Cr.P.C.
This petition stands disposed of accordingly.
