The prayer made in the writ petition is for issuance of direction to the respondents to pay amount of leave encashment of petitioner No. 2 with 18% interest from the date of retirement till payment and further to direct 18% interest on delayed payments of retrial dues from the date of retirement till the date of actual payment to the petitioners along with costs.
For the aforementioned relief claimed in the present writ petition, the petitioner has already sent a legal notice dated 24.4.2006 (P-1) to the respondents.
Without going into the merits of the case, we deem it just and appropriate to direct the respondents to take cognizance of the legal notice dated 24.4.2006 (P-1) sent by the petitioner and decide the same expeditiously preferably within a period of four months C.W.P. No. 10847 of 2006
from the date a certified copy of this order is presented to them. If the claim of the petitioners is found to be meritorious and decided in their favour then the benefit accruing to them shall be disbursed within a further period of three months thereafter. It shall be appreciated if a speaking order is passed.
Petition stands disposed of in the above terms.
