Learned counsel has not been able to point out any of the junior of the petitioner who might have been promoted from the post of Peon to that of Lab Attendant w.e.f. 5.6.1998. The claim made by the petitioner for grant of pecuniary benefits in respect of pay would be dependent as to whether any of the junior of the petitioner has been granted the pecuniary benefits despite the fact that he was senior to him/them on 5.6.1998. No document to that effect has been placed on record. Therefore, we allow learned counsel for the petitioner to withdraw the instant petition with liberty to file a fresh one on the same cause of action after disclosing full particulars.
