Prayer in this petition is, for grant of anticipatory bail in case FIR No.598 dated 27.12.2005, registered under Sections 420,467,468,471,120-B and 34 of the Indian Penal Code at Police Station Udyog Vihar, Gurgaon.

Counsel for the petitioner submits that in the title, the FIR No.

has been wrongly typed. The correct number is 596, whereas number 598 has been typed. The petitioner shall take adequate steps to correct the aforementioned error.

Counsel for the petitioner contends that the petitioner was duped by a property dealer. The petitioner had no knowledge that the photographs appearing on the Power of Attorney were not of Mary Angela Gabriel. In fact, the property dealer, who perpetuated the fraud, has already been released on regular bail.

I have heard learned counsel for the parties and perused the paper book.

The petitioner is directed to appear before the Investigating Officer on 10.8.2006 at 10 AM. The Investigating Officer shall also be present on the same date and time.

Adjourned to 19.9.2006.

Meanwhile, in the event of arrest of the petitioner, he shall be released on interim anticipatory bail by the Arresting Officer to his satisfaction, subject to the following conditions :- i)that he shall make himself available for interrogation by a police officer as and when required ;

ii)that he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; iii)that he shall not leave India without the previous permission of the Court.
