Present : Ms. Deipa Singh, Advocate, for the petitioner.
Counsel for the petitioner contends that on account of a clerical mistake made by an employee of HUDA, a cheque of Rs.60,000/- was issued instead of Rs.6,000/-. The cheque was duly credited to the petitioner's account. However, on discovery of this mistake, Rs.54,000/- was deducted from the petitioner's account and credited to the account of HUDA. It is contended that no offence, whatsoever, is made out.

Meanwhile, in the event of arrest of the petitioner, he shall be released on interim anticipatory bail by the Arresting Officer to his satisfaction, subject to the following conditions :- i)that he shall make himself available for interrogation by a police officer as and when required ;
ii)that he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; iii)that he shall not leave India without the previous permission of the Court.
