Learned counsel for respondent No.2 states, that the prayer made in the instant writ petition for stalling the action of the respondents in transferring Virender Singh, Driver to Sirsa, has already been rendered infructuous on account of the fact, that his aforesaid transfer to Sirsa, has since been cancelled.
In view of the above, the only remaining prayer of the petitioner is, that as and when appointment is made to fill up the vacancy hithertofore occupied by the petitioner, his claim be considered as a matter of preference. In so far as, the instant plea is concerned, learned counsel for CWP No. 485 of 2004 Page numbers
respondent No.2 states, that the petitioner shall be entitled to all benefits flowing to him under Section 25(F) of the Industrial Disputes Act, 1947.
In view of the above, learned counsel for the parties are agreed, that the instant writ petition has been rendered infructuous.
Disposed of as infructuous.
