Prayer in this petition is, for transferring the complaint, titled as `Karamjit Kaur V. Antar Singh' filed under Sections 406/498-A IPC, pending in the Court of Judicial Magistrate, Ist Class, Moga, to the Court of Additional Chief Judicial Magistrate, Barnala, where trial pursuant to FIR No.147 dated 21.6.2005, registered under Sections 498-A, 494, 506,120-B of the Indian Penal Code at Police Station Barnala, is pending.
I have heard learned counsel for the petitioners and perused the paper book.
The complaint has been filed under Sections 406/498 IPC. The FIR on the other hand refers to offences under Sections 498-A, 494, 506 and 120-B IPC. Thus, in essence, the offences complained of in the complaint, and in the FIR are different. The accused in both the cases are also different.
In view of the aforementioned facts, the present petition for transfer of the complaint, to the Court, where trial pursuant to an FIR is pending, is dismissed.
