It is not in dispute that in consequent to the notice issued under Section 13(4) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, symbolic possession has already been taken so far as the mortgaged property is concerned. Now that property has been notified for sale. Against taking `symbolic possession', appeal lies. No case is made out for interference. Dismissed. However, liberty is granted to the petitioner to file appeal, if so advised, before the competent authority.
