Notice of motion. Shri P.S.Chhina, Additional Advocate General, Punjab accepts notice.
It is grievance of the petitioner- Gram Panchayat that the State of Punjab has sanctioned grants for development works in its village, instead of sending that amount to the Gram Panchayat, Executive Officer, Panchayat Samiti, Ludhiana has wrongly been appointed as executing agency to spend those grants, contrary to the provisions of Punjab Panchayati Raj Act, 1994 (in short the Act).
This writ petition is disposed of with a direction to the Additional Deputy Commissioner (Development), Ludhiana, to look into grievance of the petitioner and release the amount of grant in favour of the Gram Panchayat, if there is no legal impediment in doing the same. The order be passed after giving an opportunity of hearing to the petitioner and keeping in view the provisions of Sections 30, 86 and 89 of the Act.
Needful be done within fifteen days from the date of receipt of a copy of this order. Till then amount of grant be not spent by the Executing Officers.
Copy of the order be given dasti on payment of usual charges to counsel for the petitioner and under signatures of Court Reader, to the State counsel, for necessary compliance.
