Petitioners, who are partners of M/s Kissan Electrodes Industry, Gurdaspur, have filed this writ petition with a prayer to quash taking over possession of their unit, which was lying mortgaged with respondent Nos.1 and 2 and also subsequent sale made in the year 1999.
It is contention of counsel for the petitioners that before effecting sale, proper procedure was not adopted. The manner, in which, property was evaluated, was never conveyed to the petitioners. This Court feels that at this stage, no relief can be given to the petitioners. As is apparent from the perusal of the records that the property was sold after giving publication in the newspaper and the subsequent purchaser has paid the price and property rights were conferred upon him. It is too late to say, at this stage, that the petitioners did not know about the sale of the property.
Merely because, for realization of the remaining amount, proceedings have been initiated under Section 31 of the State Financial Corporation Act, 1951, the petitioners cannot agitate the matter, which has become final in the year 1999. No case is made out for interference.
