The petitioner filed Crl.Misc.No.7299-M of 2005, which was disposed of by this Court on February 4, 2005 with a direction that the respondents shall complete the investigation within a period of six months and shall produce the whatever report they want to file in the Court.
Alleging non-compliance of the aforesaid order, this contempt petition has been filed.
In response to the show cause notice, respondent No.1 Sh.Naunihal Singh, IPS Sr. Superintendent of Police, Khanna has filed his affidavit dated 26.7.2006 which is taken on record.
In the aforesaid affidavit, it has been averred that the matter has been re-investigated in terms of the directions issued by this Court and the relevant persons have been joined the investigation and their statements under Section 161 Cr.P.C. have also been recorded. A cancellation report was again prepared on 7.12.2005, which was submitted to the Illaqa Magistrate on 18.2.2006. It has also been averred in the affidavit that vide order dated 16.3.2006 (Annexure R-1), the Illaqa Magistrate had accepted the above-stated cancellation report.
In this view of the matter, the directions issued by this Court vide order dated February 4, 2005 have been fully complied with. No further action is required to be taken in these proceedings which are accordingly dropped, however, with liberty to the petitioner to have appropriate recourse, as may be available in accordance with law and if so advised.
Petition is disposed of.
Rule stands discharged.
