The petitioner has already filed Civil Writ Petition No. 8013 of 2005, which was dismissed on September 22, 2005 on the ground of his poor record. He has again raised the same issue by challenging the Confidential report dated May 3, 2005 (P-12) and the same is impermissible. The aforementioned report was well within the knowledge of the petitioner at the time when his petition was dismissed on September 22, 2005. There is no fresh cause of action.
Dismissed.
