This petition has been filed by the petitioner alleging that despite the order dated 13th
March, 2004 (Annexure P-1) to provide him 'B' class facilities during the pendency of the trial while he is lodged in Model Jail, Burail, the respondent allegedly mal-treated him and violated the said order.
In response to the show cause notice, the respondent has filed an affidavit dated July 4, 2005. It is stated in the affidavit that the respondent has already been transferred from the post of Superintendent of Model Jail, Burail on April 20, 2005. It has been further explained that the petitioner was not shifted to Cell meant for condemned prisoners, rather, he was shifted to high-security 20 Cell Ward along with other high security prisoners and that this action was taken as a measure of safety.
As of now, it appears that there is no violation of the order COCP No.155 of 2005 -: 2 :-
dated 13.3.2004 (Annexure P-1), and, in this view of the matter, no further action is required to be taken at this stage. Consequently, this petition is disposed of.
