Atma Singha and others Vs. State of Punjab.
Present : Mr.R.S. Rangpuri, Advocate, for the petitioners.
Counsel for the petitioners contends that a perusal of the FIR reveals that no offence, whatsoever, is made out under Sections 2,3 and 4 of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as `the Act'). The complainant has filed similar complaints earlier also, against one of the accused. It is contended that the use of the words attributed to the petitioners do not make out an offence under the aforementioned Act.

Mr.B.S. Baath, Assistant Advocate General, Punjab, who is present in Court, on the asking of the Court, accepts notice and prays for time to seek instructions.
In the meanwhile, arrest of the petitioners shall remain stayed.
