Notice of motion.
Mr. Amol Rattan Singh, Addl. A.G., Punjab accepts notice on behalf of the respondents.
Learned counsel for the State has brought to our notice that the issue stands covered by an order of Division Bench of this Court, passed on 3.3.2005 in CWP No.5133 of 2001 to the following effect:-
"An affidavit filed by Amrit Singh, Senior Legal Advisor, PEPSU Road Transport Corporation, Patiala in Court is taken on record which points out that the arrears of tax are being slowly cleared, whereas, the current liabilities are being discharged as per law.
In this view of the matter, we dispose of this writ petition as infructuous."
Learned counsel has also shown a letter dated 20.7.2006 from District Transport Officer, Patiala and stated that the issue is being considered by the authorities and the dispute about the liability of the Punjab Roadways Transport Corporation to pay taxes, itself is being examined.
A copy of this letter be placed on record as Exh.'X'.
In view of the above, there is no reason to pass any further order.
Petition is disposed of, accordingly.
