JUDGMENT :

Learned counsel appearing for the petitioner states that the main writ petition itself be disposed of with direction to the respondents to consider the claim of the petitioner in the light of the Division Bench judgment passed in C.W.P.No.20530 of 2002, decided on September 26, 2003 (Hardip Singh and another v. State of Punjab and others). A copy of the aforesaid judgment has been appended as Annexure P-5.

With the consent of learned counsel for both the parties, the main petition itself is taken on board for final disposal.

Learned counsel for the petitioner has made a specific request that the main writ petition be disposed of with a direction to the respondents to consider the claim of the petitioner in the light of the judgment Annexure P-5.

Therefore, the present writ petition stands disposed of with a direction that respondents shall consider the claim of the petitioner in the light of the judgment Annexure P-5, judgment passed in CWP No.2941 of 2002 (Surinder Mohan L.D.C.Retd. v. P.S.E.B.) or any other rules/regulations and relevant material, in accordance with law.

In case, the claim of the petitioner is rejected, then a speaking C.M.No.193 of 2006 and : 2 :

C.W.P.No.17334 of 2001

order shall be passed within a period of four months, a certified copy of this order is received.

C.M. as well as the main writ petition stands disposed of, accordingly.
