Respondent filed a suit for declaration to the effect that the order dated 12.8.1996, vide which, his appeal against payment of subsistence allowance vide order dated 24.1.1995 was rejected, be declared illegal and void. He also claimed that he was entitled to claim substance allowance @ 75% of his salary. His suit was dismissed. He also failed in appeal. Hence, this Regular Second Appeal.
Both the Courts below have found it as a matter of fact that the enquiry was delayed not because of any fault on the part of the respondents, rather for the said delay, it was the appellant, who was to be blamed. It is an admitted fact that the appellant filed a suit wherein he laid challenge to the enquiry proceedings and in that suit, passing of the final order, in the enquiry was stayed. That suit was pending when the order, under challenge, was passed. No case is made out for interference in pure findings of facts.
