JUDGMENT :

The present appeal was sought to be filed by the appellant as indigent person. Report was sought from the Collector. It was reported that the appellant is not an indigent person. Consequently, on September 26, 2005, learned counsel appearing for the appellant got dismissed the aforesaid Civil Miscellaneous Application bearing C.M.No.1856-C-I of

2004. Thereafter, the appellant was required to pay the requisite court fees but he has not paid the requisite court fees till this date.

Consequently, the present appeal is dismissed for non- prosecution.
