The petitioner along with some of his co-villagers filed C.W.P.No.457 of 2001 challenging the mutation dated 30.5.1992 (Annexure P-9). The said writ petition was disposed of in the light of Full Bench judgment of this Court passed in Jai Singh and ors. vs. State of Haryana and ors.
Alleging non-compliance of the aforesaid order, this contempt petition has been filed.
In response to the show cause notice, Mr.C.R.Rana, Collector, Rewari (respondent No.2) has filed his affidavit dated January 25, 2005 and in para 6 thereof following stand has been taken:- "That the State Govt. has challenged the order passed in CWP No.5877 of 1992 titled as Jai Singh Vs. State by Hon'ble High Court by filing S.L.P.No.18082 of 2003 in the Hon'ble Supreme Court of India. The Hon'ble Supreme Court has issued notice vide order dated 24.9.2003 and the S.L.P. is still pending in the Hon'ble Supreme Court. However the deponent has already directed the Revenue Authorities to take necessary action as per order dated 13.3.2003 of Hon'ble High Court passed in C.W.P.No.5877 of 1992 regarding change of Mutation No.1243 whereafter a Mutation No.1871 has been sanctioned in the name of Jumla Malkan. Accordingly the orders passed by this Hon'ble High Court in CWP No.457 of 2001 on 6.10.2003 have been fully complied with." In this view of the matter, this petition has been rendered infructuous.
Rule stands discharged.
