After hearing learned counsel for the parties, though prima facie, there can be no doubt that the respondent is guilty of flouting the order dated August 29, 2005 (Annexure P1) passed by this Court.
However, in order to purge the contempt, the respondent has handed over to the petitioner a Demand Draft bearing No.28180 dated 5.8.2006, in the sum of Rs.26,000/-.
However, it is pointed out by learned counsel for the petitioner that the aforesaid draft is short of Rs.2,000/-. In addition, it is also contended and rightly so that the petitioner is entitled to be compensated for this avoidable bout of litigation.
Faced with the situation, the respondent, who is present in person has tendered a sum of Rs.7,000/- to the petitioner who too is personally present. The aforesaid amount of Rs.7,000/- includes Rs.2,000 as the arrears of maintenance as well as Rs.5,000/- towards the costs of this litigation.
Having regard to the fact that the respondent has complied with the order dated August 29, 2005 passed by this Court and has also compensated the petitioner with costs, I am inclined to take a lenient view and consequently drop these proceedings.
Rule stands discharged.
