Bir Singh v. State of Haryana - CWP-20088-2005 RD-P&H 5172 (3 August 2006)
CWP No. 20088 of 2005
Date of decision 21.8.2006
Bir Singh .. petitioner
State of Haryana and others .. Respondents
CORAM: HON'BLE MR. JUSTICE M.M. KUMAR
HON'BLE MR. JUSTICE M.M.S. BEDI
PRESENT: Mr.GP Singh, Advocate for the petitioner Mr. Harish Rathee, Sr. DAG Haryana.
The challenge in this petition is to the order dated 30.5.2005 ( Annexure P.10) declining the prayer of the petitioner for regularization of his services on Group III post whereas he has been regularised on Group B post i.e. Pump Attendant. However, in view of the authoritative view taken by the Hon'ble Supreme Court in a Constitution Bench judgment in the case of Secretary, State of Karnataka vs. Umadevi and others, (2006) 4 SCC 1 regularisation has not been considered as a mode of recruitment. Such like arguments have also been considered by us in the case of Rajinder Kumar v.
State of Haryana and others ( C.W.P.No. 7563 of 2005 decided on 25.4.2006).
In view of the above, the writ petition fails and the same is dismissed.
