On the last date of hearing the petitioner was asked to place on record seniority list so as to establish the right of the petitioner that he was entitled to be deputed on the Lower School Course under 35% quota of seniority-cum-fitness. All that has been produced before us at the time of hearing is the list of eligible candidates for B-I Test for the year 2005 (District Karnal). The C.W.P. No. 11427 of 2006
aforementioned document cannot be considered as seniority list.
Therefore, we cannot proceed on the basis of list of eligible candidates for B-I Test for the year 2005 (District Karnal).
Accordingly, we allow withdrawal of the writ petition with liberty to file a fresh one on the same cause of action after comprehensive pleadings and documents.
