Versus

State of Haryana and others

...Respondents

CORAM: HON'BLE MR. JUSTICE M.M. KUMAR
HON'BLE MR. JUSTICE M.M.S. BEDI

PRESENT: Mr. Madan Pal, Advocate,

for the petitioner.

JUDGMENT

M.M. KUMAR, J. (Oral)

The matter herein concerns simple order of transfer. It appears that there is some mistake in the impugned order of transfer, dated 8.7.2006 (P-4), wherein the name of the petitioner is mentioned at Sr. No. 11. In the column concerning present place of posting the comment made is that he is under transfer from Government High School, Saimpal, District Rohtak, to Government High School, Polangi, District Rohtak. The aforementioned order has been issued C.W.P. No. 12846 of 2006

on 8.7.206 whereas the petitioner has already joined from Government High School, Saimpal, District Rohtak to Government High School, Polangi, District Rohtak, on 14.6.2006 (P-3). The grievance made is that once the petitioner has already joined on 14.6.2006 (P-3) he cannot be transferred again by describing him that he was under transfer whereas the earlier transfer order, in fact, has come into operation by the joining of the petitioner. The aforementioned mistake has already been brought to the notice of the respondents by the petitioner by filing representation, dated 14.8.2006 (P-7). The aforementioned representation is still pending consideration of the respondents.

In view of the above, we direct respondent No. 2 to take cognisance of the representation, dated 14.8.2006 (P-7) made by the petitioner and decided the same in accordance with law preferably within a period of two weeks from the date of receipt of certified copy of this order.

The writ petition stands disposed of in the above terms.
