The petitioners have approached this Court seeking directions against the respondents to make the payment of compensation to the tune of Rs.10 lacs for causing death of Jiwa Ram.

In support of their claim, the petitioners have relied upon the judgment dated March 6, 2006 passed by the civil court whereby, according to the petitioners, claim of the identical situated claimants has been allowed.

Without commenting upon the merits of the claim made by the petitioners, we dispose of the present petition with a direction to respondent No.2, Executive Engineer, City Sub Division, Uttri Bijli Vitran Nigam Limited to consider the claim made by the petitioners.

For this purpose, the petitioners shall be required to file a detailed and comprehensive representation annexing all the relevant documents including a copy of the judgment of the civil court within a period of four weeks from the date a certified copy of this order is received. On receipt of the aforesaid representation, Executive Engineer, respondent No.2 shall take a final decision upon the aforesaid representation by passing a speaking and detailed order and take other action, as may be required in accordance with law, within four months from the date of filing of the aforesaid representation.

A copy of the order be given dasti on payment of usual charges.
