Notice of motion to the respondents.

Shri Ashok Jindal, Additional Advocate General,Haryana, who is present in the court, accepts notice on behalf of the respondents on the asking of the Court.

After hearing the learned counsel for the petitioner and taking into consideration the averments made in the present petition, we find that the primary grievance of the petitioner is that the petitioner has not been heard before the action of sealing has been done by respondents No.2 and 3.

Another grievance is that even a show cause notice was not issued to the petitioner.

Consequently, we dispose of the present petition with a liberty to the petitioner to file a detailed representation before Senior Town Planner-cum- Chairman Building Composition Committee,respondent No.3, within a period of one week from the date a certified copy of this order is received. In the aforesaid representation, the petitioner shall give all the necessary details and annex all documents which are relevant for C.W.P. No.7363 of 2006 2

adjudication of the aforesaid claim. On receipt of the aforesaid representation, respondent No.3 shall consider the same and after affording an opportunity of hearing to the petitioner shall pass a detailed speaking order within a period of two weeks therefrom. If any adverse adverse to the petitioner is passed, then the petitioner would be entitled to seek his remedy before the Tribunal constituted under section 12(c) of the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act,1963.

A copy of this order be given dasti on usual charges.
