On the asking of Court, Shri Ashok Jindal, Additional Advocate General, Haryana accepts notice on behalf of the respondents.
Copies of the writ petition have been supplied to the learned counsel for the respondents.
The petitioners claim that they have filed an application under Section 9(b)(i) of Haryana Development and Regulation of Urban Area Act, 1975 for exempting them from obtaining any licence under the Act. The aforesaid application is alleged to have been filed on July 31, 2006. According to the petitioners, although no decision on the aforesaid application has been taken by the Director, Town and
Country Planning, Haryana, respondent No.1 so far but still the authorities are proceeding for demolishing the construction and removing the roads.
After hearing the learned counsel for the petitioners, we dispose of the present petition with a direction to the Director, Town and Country Planning, Haryana, respondent No.1 to take a final decision on the aforesaid application (Annexure P.2), if still pending, within a period of one month from the date a certified copy of this order is received.
A copy of the order be given dasti on payment of usual charges.
